Legal Notice: These Terms of Service constitute a legally binding agreement between you and ApexBase LLC regarding your use of PikBase AI-assisted Backend as a Service platform. By accessing or using PikBase services, you agree to be bound by all terms and conditions contained herein. If you do not agree to these terms, you must immediately discontinue use of PikBase services.
1. Definitions and Interpretation
1.1 Key Definitions
For the purposes of these Terms of Service, the following definitions shall apply:
"Agreement" means these Terms of Service, together with any amendments, modifications, or supplements thereto.
"ApexBase" or "Company" or "we" or "us" or "our" means ApexBase LLC, a limited liability company organized under the laws of New Mexico, with its principal place of business at 1209 MOUNTAIN ROAD PL NE STE N, ALBUQUERQUE, NM 87110.
"PikBase" or "Platform" or "Services" means the AI-assisted Backend as a Service platform, including all related tools, APIs, databases, hosting services, MCP integrations, CLI tools, and associated software and services provided by ApexBase.
"Customer" or "you" or "your" means the individual or entity that accesses or uses PikBase services.
"Authorized Users" means individuals specifically authorized by Customer to access and use PikBase services under Customer's account, including development team members and project collaborators.
"Customer Applications" means applications, websites, services, and other software solutions developed by Customer using PikBase Backend as a Service platform.
"Customer Data" means all data, content, code, configurations, databases, files, and information uploaded, stored, processed, or generated by Customer through PikBase services.
"Backend as a Service (BaaS)" means the cloud-based platform services including databases, APIs, authentication, file storage, hosting, and related infrastructure services provided by PikBase.
"AI-Assisted Development" means the artificial intelligence tools, features, and capabilities provided by PikBase to enhance development workflows, including code suggestions, automated optimizations, and intelligent recommendations.
"MCP Tools" means Model Context Protocol integration tools and servers that enable AI assistants to interact with PikBase services and development workflows.
"CLI Tools" means command-line interface tools and utilities for managing PikBase services, applications, and development workflows.
"Vibe Coding" means the AI-assisted development methodology and workflow supported by PikBase for rapid, intuitive application development.
"GSB Infrastructure" means the Global Software Base infrastructure technology that powers PikBase services.
2. Acceptance and Scope of Agreement
2.1 Agreement Formation
By creating a PikBase account, accessing the platform, or using any Backend as a Service features, you acknowledge that you have read, understood, and agree to be bound by this Agreement. This Agreement becomes effective upon your first use of PikBase services and remains in effect until terminated in accordance with these terms.
2.2 Authority and Eligibility
If you are accessing PikBase on behalf of an organization, you represent and warrant that:
- You have the authority to bind that organization to this Agreement
- You are at least 18 years of age and legally capable of entering into contracts
- Your organization is duly organized and validly existing
- The execution and performance of this Agreement has been duly authorized
- Your use of PikBase services complies with all applicable laws and regulations
2.3 Service Modifications
We reserve the right to modify these Terms of Service at any time. Material changes will be communicated through:
- Email notification to your registered email address
- Prominent notice within the PikBase platform dashboard
- In-application notifications for significant changes
- Updated terms posted on our website
Your continued use of PikBase services after such notification constitutes acceptance of the modified terms.
3. GSB Infrastructure Authorization and Licensing
3.1 GSB Technology Authorization
PikBase operates on the GSB (Global Software Base) infrastructure under the comprehensive authorization of Ali YILDIRIM, the original developer and intellectual property owner of the GSB infrastructure. This authorization includes:
- Rights to develop and operate Backend as a Service platforms using GSB technology
- Authority to provide AI-assisted development tools and vibe coding capabilities
- Permission to offer MCP integration and CLI tools for enterprise development
- Rights to enhance and create derivative works based on GSB infrastructure
- Authorization to collect and process data necessary for platform operations
- Rights to license GSB-based capabilities to customers and development teams
3.2 Customer License to Use PikBase
Subject to your compliance with this Agreement, ApexBase grants you a limited, non-exclusive, non-transferable, revocable license to:
- Access and use PikBase Backend as a Service platform for your development projects
- Utilize AI-assisted development tools and vibe coding capabilities
- Deploy Customer Applications using PikBase hosting and infrastructure
- Use MCP tools and CLI integration for your development workflows
- Allow your Authorized Users to access and use PikBase services
- Access and use platform documentation and educational resources
3.3 License Restrictions
You may not:
- Reverse engineer, decompile, or disassemble PikBase platform or GSB infrastructure
- Attempt to gain unauthorized access to platform systems or other customers' data
- Use PikBase services to develop competing Backend as a Service platforms
- Resell, redistribute, or sublicense PikBase services without explicit authorization
- Use the platform for any illegal, harmful, or malicious activities
- Violate any usage limits, quotas, or restrictions specified in your service plan
4. Platform Services and Capabilities
4.1 Backend as a Service Features
PikBase provides comprehensive Backend as a Service capabilities including:
- Database Services: Managed databases with automatic scaling, backups, and optimization
- API Management: RESTful APIs, GraphQL endpoints, and custom API development tools
- Authentication & Authorization: User management, role-based access control, and security features
- File Storage: Secure file uploads, storage, and content delivery
- Hosting & Deployment: Application hosting with automatic scaling and global distribution
- Real-time Features: WebSocket support, real-time synchronization, and live updates
4.2 AI-Assisted Development Tools
PikBase offers AI-powered development capabilities including:
- Intelligent code suggestions and auto-completion
- Automated API endpoint generation and optimization
- Database schema recommendations and query optimization
- Security best practices analysis and implementation
- Performance monitoring and optimization suggestions
- Automated testing and deployment pipeline recommendations
4.3 MCP and CLI Integration
PikBase provides advanced integration tools including:
- Model Context Protocol servers for AI assistant integration
- Command-line tools for development workflow automation
- Integration with popular IDEs and development environments
- Automated deployment and continuous integration tools
- Project scaffolding and boilerplate generation
4.4 Service Availability and Performance
We strive to maintain high service availability for PikBase platform:
- Target Uptime: 99.9% availability for core Backend as a Service features
- Performance Monitoring: Continuous monitoring of platform performance and response times
- Maintenance Windows: Scheduled maintenance with advance notice to minimize disruption
- Incident Response: Rapid response to service disruptions and technical issues
- Global Infrastructure: Distributed infrastructure for optimal performance worldwide
5. Account Management and Security
5.1 Account Registration and Setup
To use PikBase services, you must create an account providing:
- Valid email address and contact information
- Strong authentication credentials and security settings
- Accurate billing and payment information (for paid plans)
- Company information for enterprise accounts
- Technical requirements and integration preferences
5.2 Account Security Responsibilities
You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Immediately notifying us of any unauthorized access or security breaches
- Using strong passwords and enabling two-factor authentication
- Ensuring that Authorized Users comply with security requirements
- Regularly reviewing and updating account access permissions
5.3 Team and User Management
For team accounts, you can:
- Add and remove team members and Authorized Users
- Assign roles and permissions based on job functions
- Monitor team usage and project collaborations
- Configure project access controls and sharing settings
- Manage billing and subscription settings for your team
6. Acceptable Use Policy
6.1 Permitted Uses
You may use PikBase for lawful development purposes including:
- Developing and deploying web applications, mobile apps, and software services
- Creating databases, APIs, and backend infrastructure for your projects
- Using AI-assisted development tools for code optimization and enhancement
- Collaborating with team members on development projects
- Integrating with third-party services and development tools
- Learning and educational purposes related to software development
6.2 Prohibited Uses
You are prohibited from using PikBase for:
6.2.1 Illegal and Harmful Activities
- Any activity that violates applicable laws or regulations
- Developing applications for illegal gambling, fraud, or financial crimes
- Creating malware, viruses, or malicious software
- Harassment, abuse, or threatening behavior toward other users
- Intellectual property infringement or unauthorized use of copyrighted materials
6.2.2 Platform Abuse and Security Violations
- Attempting to breach platform security measures or access controls
- Denial of service attacks or similar disruptive activities
- Exceeding usage limits, quotas, or rate restrictions
- Using automated tools to scrape or extract platform data
- Interfering with the normal operation of PikBase services
- Accessing other customers' data or applications without authorization
6.2.3 Commercial and Competitive Violations
- Reselling or redistributing PikBase services without authorization
- Creating competing Backend as a Service platforms using our technology
- Benchmarking PikBase for competitive analysis without permission
- Using PikBase to directly benefit competitors
6.3 Content and Data Restrictions
Customer Applications and Customer Data must not:
- Violate intellectual property rights of third parties
- Contain personal information collected without proper consent
- Include defamatory, obscene, or offensive content
- Promote hate speech, discrimination, or violence
- Violate privacy laws or data protection regulations
- Include unauthorized copyrighted or trademarked materials
7. Payment Terms and Billing
7.1 Service Plans and Pricing
PikBase offers various service plans including:
- Free Tier: Limited usage for development and testing purposes
- Developer Plans: Enhanced features and higher usage limits for individual developers
- Team Plans: Collaboration features and team management capabilities
- Enterprise Plans: Advanced features, priority support, and custom integrations
- Usage-Based Billing: Pay-as-you-go pricing for certain services and resources
7.2 Billing and Payment
Payment terms include:
- Payment Methods: Credit card, ACH transfer, or enterprise invoicing
- Billing Frequency: Monthly or annual billing cycles
- Automatic Renewal: Subscriptions renew automatically unless cancelled
- Usage Overages: Additional charges for usage exceeding plan limits
- Payment Due: Payment is due immediately upon subscription or usage
7.3 Free Tier Limitations
Free tier accounts are subject to:
- Limited database storage and API requests
- Restricted file storage and bandwidth
- Basic support through community channels
- Limited AI-assisted development features
- Platform usage restrictions and quotas
7.4 Refunds and Credits
Refund policies include:
- Pro-rated Refunds: Available for annual subscriptions cancelled early
- Service Credits: May be provided for significant service disruptions
- Usage Charges: Generally non-refundable once services are consumed
- Dispute Resolution: Contact support within 30 days for billing disputes
8. Data Ownership and Privacy
8.1 Customer Data Ownership
Data ownership rights are clearly defined:
- Customer Data: You retain full ownership of all Customer Data and Applications
- Platform Data: We own data related to platform operation and performance
- Usage Analytics: We may use aggregated, anonymized data for platform improvement
- AI Training: Customer Data is not used for AI model training without explicit consent
8.2 Data Processing and Use
We process Customer Data to:
- Provide and maintain PikBase Backend as a Service platform
- Support Customer Applications and technical assistance requests
- Ensure platform security and prevent abuse
- Provide AI-assisted development features and recommendations
- Comply with legal obligations and regulatory requirements
8.3 Data Security and Protection
We implement comprehensive security measures including:
- End-to-end encryption for data transmission and storage
- Access controls and authentication systems
- Regular security assessments and monitoring
- Backup and disaster recovery procedures
- Compliance with industry security standards
9. Intellectual Property Rights
9.1 PikBase Platform Rights
ApexBase owns all right, title, and interest in:
- PikBase platform, services, and underlying technology
- GSB infrastructure and related intellectual property
- AI-assisted development algorithms and machine learning models
- MCP tools, CLI utilities, and development frameworks
- Platform documentation, APIs, and technical specifications
- Trademarks, service marks, and brand elements
9.2 Customer Application Rights
Customer retains ownership of:
- Customer Applications and software developed using PikBase
- Customer Data, content, and configurations
- Pre-existing intellectual property and third-party licenses
- Custom code, designs, and application-specific innovations
9.3 Feedback and Contributions
Any feedback, suggestions, or contributions provided to PikBase become our property and may be used without obligation or compensation for platform improvement and development.
10. Service Level Agreements and Support
10.1 Platform Availability
PikBase strives to maintain:
- 99.9% uptime for core Backend as a Service features
- 99.5% uptime for AI-assisted development tools
- Rapid response to critical service incidents
- Proactive monitoring and maintenance procedures
10.2 Support Services
Support is provided based on your service plan:
- Community Support: Available for free tier users through forums and documentation
- Email Support: Available for paid plan subscribers
- Priority Support: Faster response times for team and enterprise plans
- Dedicated Support: Assigned support representatives for enterprise customers
11. Termination and Data Management
11.1 Account Termination
Either party may terminate this Agreement:
- For convenience with 30 days' written notice
- Immediately for material breach that remains uncured after notice
- For violation of acceptable use policies
- For non-payment of fees after grace period
11.2 Data Export and Deletion
Upon termination:
- You have 30 days to export your Customer Data and Applications
- We will delete your data within 90 days after account termination
- Enterprise customers may negotiate longer data retention periods
- Backup copies may be retained for disaster recovery purposes
12. Limitations of Liability and Warranties
12.1 Service Warranties
PikBase warrants that:
- Services will perform substantially as described in documentation
- Platform will be provided in a professional manner
- We have appropriate rights to provide Backend as a Service platform
- Services will comply with applicable laws and regulations
12.2 LIMITATION OF LIABILITY
IN NO EVENT SHALL APEXBASE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, REVENUE, DATA, OR USE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY ARISING OUT OF OR RELATED TO PIKBASE SERVICES SHALL NOT EXCEED THE TOTAL FEES PAID BY YOU IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY.

14. Governing Law and Dispute Resolution
14.1 Governing Law
This Agreement is governed by the laws of New Mexico without regard to conflict of laws principles.
14.2 Dispute Resolution
Before initiating formal proceedings, parties agree to attempt resolution through:
- Direct negotiation between designated representatives
- Good faith discussions for 30 days
- Mediation if informal resolution fails
- Binding arbitration for unresolved disputes
14.3 Class Action Waiver
Both parties waive any right to participate in class action lawsuits or class-wide arbitration related to PikBase services.
